Flowstate Kids Terms & Conditions

Welcome to Flowstate Kids. By enrolling a child in a Flowstate Kids program, trial session, membership, incursion, or activity, you agree to the following Terms and Conditions.
1. About Flowstate Kids
Flowstate Kids provides movement-based fitness and wellbeing programs for children. Sessions may include, but are not limited to:

Fitness activities
-
Non-contact boxing activities
-
Movement games
-
Coordination exercises
-
Obstacle courses
-
Breathing exercises
-
Visualisation activities
-
Confidence-building activities
-
Wellbeing and mindset education
Programs are designed to support children's physical, emotional, and social development through age-appropriate activities.
2. Participation Requirements
By enrolling a child in Flowstate Kids, the parent, guardian, or authorised representative confirms that:

The child is physically capable of participating.

Any relevant medical conditions, injuries, allergies, behavioural concerns, or additional support needs have been disclosed prior to participation.

The child participates voluntarily.
Flowstate Kids reserves the right to refuse participation where safety concerns exist.
3. Assumption of Risk
While every reasonable effort is made to provide a safe environment, participation in physical activity carries inherent risks including but not limited to:

Slips, trips, and falls
-
Minor injuries
-
Accidental contact with equipment
-
Physical exertion-related injuries
Parents and guardians acknowledge these risks and accept that participation is undertaken at their own risk.
4. Medical Emergencies
In the event of illness, injury, or emergency, Flowstate Kids staff may:

Seek first aid treatment
-
Contact emergency services
-
Notify parents, guardians, or childcare staff
Any costs associated with emergency medical treatment remain the responsibility of the participant's parent or guardian.
Flowstate Kids does not administer medication unless otherwise agreed in writing.
5. Child Supervision
When programs are delivered within childcare centres, schools, or outside school hours care services, responsibility for overall supervision remains with the hosting service and its educators.
Flowstate Kids staff are responsible only for delivering the program.
6. Memberships and Payments
Where applicable:

Membership fees are charged on a recurring basis.

Payments are processed automatically through the nominated payment method.

Memberships remain active until cancelled.
-
No lock-in contracts apply unless otherwise stated.
-
Parents may cancel at any time by providing written notice.
Failure to pay membership fees may result in suspension of participation until payment is received.
7. Missed Sessions
No refunds, credits, or make-up sessions will be provided for participant absences, including but not limited to:

Illness
-
Holidays
-
Personal commitments
-
Family circumstances
Where Flowstate Kids cancels a session, reasonable efforts will be made to provide a replacement session, credit, or alternative arrangement where practicable.
8. Program Changes
Flowstate Kids reserves the right to:

Change lesson content
-
Modify activities
-
Change session locations
-
Substitute instructors
-
Adjust schedules where required
These changes may occur without prior notice where necessary for operational or safety reasons.
9. Behaviour Expectations
Flowstate Kids aims to provide a safe and positive environment for all children.
Children displaying behaviour that:

Places themselves at risk,
-
Places others at risk,
-
Causes repeated disruption,
may be removed from activities or have participation suspended.
No refund is required where participation is suspended due to unsafe behaviour.
10. Photography and Media
Flowstate Kids may take photographs or videos during sessions for educational, promotional, or marketing purposes.
Images may be used on:

Website
-
Social media platforms
-
Promotional materials
-
Printed marketing materials
Where a parent, guardian, or centre has not provided media consent, reasonable efforts will be made to exclude the child from media content.
11. Limitation of Liability
To the maximum extent permitted by law:
Flowstate Kids, its directors, employees, contractors, volunteers, and representatives shall not be liable for:

Personal injury
-
Property damage
-
Loss
-
Expense
-
Indirect or consequential damages
arising from participation in any Flowstate Kids activity except where liability cannot be excluded under Australian law.
Nothing in these Terms excludes rights available under the Australian Consumer Law.
12. Insurance
Flowstate Kids maintains appropriate insurance coverage, including public liability insurance, relevant to the services provided.
Evidence of insurance may be provided to centres upon request.
13. Child Safety
Flowstate Kids is committed to maintaining child-safe practices.
All instructors engaged in program delivery are required to maintain:

Valid Working With Children Check clearance

Relevant qualifications where applicable
-
Compliance with child-safe standards
14. Intellectual Property
All program content, lesson plans, branding, educational materials, worksheets, activities, videos, and resources remain the intellectual property of Flowstate Kids.
These materials may not be copied, reproduced, distributed, sold, or used commercially without written permission.
15. Force Majeure
Flowstate Kids shall not be liable for delays, cancellations, interruptions, or inability to provide services arising from circumstances beyond reasonable control, including:

Severe weather

Natural disasters
-
Public health emergencies
-
Government restrictions
-
Facility closures
-
Staff illness
16. No Guaranteed Outcomes
Flowstate Kids aims to support confidence, wellbeing, resilience, focus, and movement development.
However, individual outcomes vary and no guarantee is made regarding specific behavioural, physical, emotional, educational, or developmental results.
17. Privacy
Personal information collected will be used solely for the administration and delivery of services.
Flowstate Kids will take reasonable steps to protect personal information in accordance with applicable Australian privacy laws.
18. Acceptance
By enrolling a child, attending a trial session, participating in a program, or maintaining an active membership, parents, guardians, participants, and centres acknowledge that they have read, understood, and agreed to these Terms and Conditions.
